 The Declaration of Covenants, also known as the Declaration or Master Deed, is the foundational legal document that establishes a homeowners association. This document is recorded with the county and legally binds all current and future owners.

Why is the Declaration important?

It gives the HOA its authority. The Declaration establishes the association’s power to collect dues, enforce rules, and maintain shared property. It also outlines key obligations for homeowners and typically requires a supermajority vote to amend.
