What is a nuisance clause in an HOA?

A nuisance clause prohibits behavior that interferes with the peace, comfort, or property values of the community, such as excessive noise or foul odors. These clauses are typically found in the association’s governing documents, especially the Declaration of Covenants (CC&Rs).

Why is a nuisance clause important?

It protects residents’ quality of life and provides a basis for enforcement when complaints arise. However, because “nuisance” can be open to interpretation, boards should ensure their enforcement process is consistent, well-documented, and in line with the governing documents.
